IMPORTANT MEDICAL DISCLAIMER
- Exzema is a tracking and journaling tool, NOT a medical device. The information, insights, and data provided by the Exzema website and mobile application are for informational purposes only and do not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind. You should always seek the advice of a qualified healthcare provider or dermatologist with any questions regarding a medical condition, skin condition, or changes to your diet, lifestyle, or treatment plan. Never disregard professional medical advice or delay seeking it because of something you have read on this website or app. In the case of a medical emergency, call your doctor or emergency services immediately.
1. Acceptance of Terms
By downloading, installing, or using Exzema, you agree to these Terms. If you do not agree, you must not use the app. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the app.
2. Description of Service
Exzema is a mobile application that helps users identify potential eczema triggers through self-reported symptom tracking and statistical correlation analysis. The app provides tools for daily logging, elimination experiments, environment tracking, and doctor-ready reports.
3. Subscription Terms
The app requires an active subscription to use. After completing onboarding, access to all features requires an active "Exzema Pro" subscription.
- Subscription is billed as an auto-renewing subscription through the Apple App Store or Google Play Store.
- Subscription periods offered include weekly, monthly, and annual terms. Exact prices are displayed in the user's local currency in the App Store before purchase.
- Payment: charged to the user's Apple ID / Google Play account at confirmation of purchase.
- Renewal: subscription automatically renews unless canceled at least 24 hours before the end of the current period.
- Cancellation: users can cancel at any time through their device's subscription management settings.
- No refund policy: refunds are handled by Apple/Google per their policies, not by the developer.
- Free trial: If offered, the trial duration is specified at checkout and will automatically convert to a paid subscription at the end of the trial unless canceled.
- Price changes: the user will be notified of price changes and must opt-in to continue at the new price.
4. User Accounts
Users start with an anonymous account (no email required initially). Users may optionally link an email address for account backup and cross-device access. Users are responsible for maintaining the confidentiality of their account credentials. One account per person — sharing accounts is not permitted.
5. User Content & Data Ownership
Users retain ownership of all health data they input into the app. By using the app, users grant Exzema a limited, non-exclusive license to process their data solely for the purpose of providing the service (correlation analysis, insights, reports). We do not claim ownership of user-generated health data. Users can export their data at any time (doctor export feature) and delete their account and all associated data at any time.
6. Acceptable Use
Users agree not to:
- Use the app for any unlawful purpose.
- Attempt to reverse engineer, decompile, or disassemble the app.
- Attempt to access other users' data.
- Submit false, misleading, or fraudulent bug reports.
- Use automated tools (bots, scrapers) to interact with the app.
- Attempt to circumvent the subscription requirement.
7. Intellectual Property
The Exzema app, including its design, code, algorithms, and content, is owned by Martin Mojžíš. The correlation algorithm (point-biserial, LASSO regression, time-lagged analysis) is proprietary. All trademarks, logos, and service marks are the property of Martin Mojžíš. The app is built using open-source frameworks (React Native, Expo) — their licenses apply to their respective components.
8. Limitation of Liability
The app is provided "AS IS" and "AS AVAILABLE". The developer makes no warranties, express or implied, regarding the accuracy of health insights, the reliability of the service, or its fitness for a particular purpose.
To the maximum extent permitted by law, the developer is not liable for:
- Any health decisions made based on app insights.
- Loss of data due to device failure, network issues, or service interruptions.
- Indirect, incidental, consequential, or punitive damages.
Total liability is limited to the amount the user paid for the subscription in the preceding 12 months. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by applicable law.
9. Indemnification
Users agree to indemnify and hold harmless Martin Mojžíš from any claims, damages, or expenses arising from misuse of the app, violation of these Terms, or health decisions made based on app data.
10. Service Modifications & Termination
The developer reserves the right to modify, suspend, or discontinue the app at any time. Active subscriptions will be honored through their paid period. Users may terminate their account at any time. The developer may terminate accounts that violate the Terms.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Slovak Republic. For EU users: consumers retain the right to bring claims in their local courts under EU consumer protection laws. EU consumers may also refer to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
12. Severability
If any provision is found unenforceable, the remaining provisions continue in effect.
13. Entire Agreement
These Terms constitute the entire agreement between the user and the developer, and supersede any prior agreements or understandings.
